1. Acceptance of Terms

By accessing or using the website located at https://brightstarbhs.com/ (the “Site”), including our employee training portal, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Site.

These Terms apply separately to two groups of users:

  • General visitors and prospective clients/guardians, who may browse the Site or submit inquiry/contact forms
  • Staff (employees and contractors), who are issued accounts to access the training portal

Sections specific to one group are labeled accordingly.

2. Not Medical or Clinical Advice

Nothing on this Site constitutes medical, psychological, behavioral, or clinical advice, and use of this Site does not create a client relationship or a therapist-client relationship. Information on the Site is for general informational purposes only. If you are seeking ABA therapy services for yourself or a dependent, please contact us directly to begin a formal intake process.

3. Website Use — All Visitors

You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to any portion of the Site, including the training portal
  • Interfere with or disrupt the Site’s functionality or security
  • Copy, scrape, or reproduce Site content without permission, except as necessary for normal browsing

4. Training Portal Access — Staff Only

4.1 Account Registration

Training portal accounts are created directly by Company administrators. Self-registration is not available. Staff may not create accounts on behalf of others or share their login credentials with any other person, including coworkers.

4.2 Individual Accountability

Each Staff member is individually responsible for completing their own assigned training. Completing training on behalf of another employee, or allowing another person to complete your assigned training, is strictly prohibited and may result in disciplinary action, including termination.

4.3 Required Training

Certain courses (including but not limited to HIPAA, OSHA/accident prevention, anti-harassment, and role-specific compliance training) are mandatory conditions of continued employment. Staff must complete assigned training by any deadline communicated by the Company.

4.4 Certificates and Completion Records

Certificates issued upon course completion reflect that the named individual’s account completed the associated coursework. Staff acknowledge that training completion data, quiz scores, and certificates may be used as compliance records and may be reviewed in the event of an audit, investigation, or licensing review.

4.5 Account Security

Staff are responsible for maintaining the confidentiality of their login credentials and for all activity that occurs under their account. Notify the Company immediately of any suspected unauthorized use of your account.

5. Intellectual Property

All training content, course materials, videos, quizzes, and certificates provided through the Site are the property of the Company or its licensors (including third-party course providers, where applicable) and are provided solely for internal training purposes. Staff may not copy, distribute, reproduce, or share training content outside of the Company without prior written permission.

6. Third-Party Links and Content

The Site may contain links to, or reference, third-party websites, resources, or training content (for example, licensed HIPAA training modules or informational resources about autism and ABA therapy). Such material is provided for reference only and does not constitute an endorsement of any third party, clinical method, treatment, service, or organization. We do not operate or control these third-party sites or materials and are not responsible for their content, accuracy, availability, or practices. Access to any third-party site is at your own risk and subject to that site’s own terms and privacy practices.

7. Disclaimer of Warranties

The Site and training portal, and any materials or resources made available through them, are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or training portal will be uninterrupted, error-free, or free of viruses or other harmful components, or that any defects will be corrected. You assume responsibility for maintaining your own means of reconstructing any lost data. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

8. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in any way connected with your use of, or inability to use, the Site or training portal, whether based on contract, tort, strict liability, or otherwise, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the limitation or exclusion of incidental or consequential damages, so the above limitation may not apply to you. This section gives you specific legal rights, and you may have other rights that vary by jurisdiction.

9. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its owners, officers, employees, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your violation of these Terms; (b) any misrepresentation you make in connection with your use of the Site or training portal; or (c) your misuse of the Site, the training portal, or any content or materials made available through them.

10. Termination of Access

The Company reserves the right to suspend or terminate any Staff member’s access to the training portal at any time, including upon separation of employment, or in cases of suspected misuse of the account (e.g., credential sharing).

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

12. Changes to These Terms

We may revise these Terms from time to time. Continued use of the Site or training portal after changes are posted constitutes acceptance of the revised Terms. Material changes affecting Staff obligations will be communicated directly.
